“The justice sector has only recently begun to integrate digitization and automation into process management” says Cristiano Morganti, CEO of Net Service Lux, the local subsidiary of Net Service, an international player specialized in eJustice. Accompanying the transformation of the judicial system, at both European and national levels, is a major challenge today.
Over the past 25 years, first in Italy, then in supporting European projects, Net Service has acquired unique experience in eJustice. The company, which is now pursuing its international ambitions from Luxembourg, has developed in-depth expertise and a tailored approach to supporting the digitization projects of judicial institutions. This is one of the least advanced areas in terms of digitization” admits Cristiano Morganti. While dematerialization, exchange and document management technologies are now very advanced, many judicial procedures still rely heavily on paper, following traditional patterns.”
Opportunities… but above all, challenges
It’s not that Justice is resistant to change. On the contrary. The difficulty lies in the fact that judicial activity must be regulated and comply with the rules of procedure.
. The way procedures were established in another era makes transformation projects particularly complex. At a time when litigation processing times are tending to get longer, in a society where business is becoming increasingly judicialized, there is a real opportunity to put the possibilities offered by digital technology at the service of a more efficient justice system.
“The dematerialization of documents while preserving their legal value is a first challenge, which should facilitate exchanges and speed up processing. Beyond that, there are also many automation technologies, including AI, that could be implemented to support justice professionals on a daily basis”, comments Cristiano Morganti.
Striking the right balance
Generally speaking, the technology is available. Existing solutions on the market have already proved their worth as major performance enhancers in many other sectors. However, the justice system is not an institution like any other. Established procedures must guarantee fair and impartial treatment, in which the role of the judge and the interpretation of the actual case remain paramount.
Making them evolve raises many questions. “The deployment of workflow automation and artificial intelligence in the service of justice, for example, leads to some interesting reflections. It leads us to ask ourselves: to what level can we delegate processing to an algorithm, with the main concern being to guarantee the judge’s freedom and impartiality in the service of a correct interpretation of the law,” explains the CEO. The challenge is to strike an ethical balance between the need to automate, to make the justice system more efficient, and the requirement to ensure quality justice.”
Seeking efficiency gains
Although this is not a simple equation to solve, Net Service has acquired considerable experience in supporting projects to transform the justice system. Within the judicial system, technological developments are enabling major efficiency gains on many levels. “Before we get to technology-based decision-making, many procedures can be automated. Whether in terms of case management, exchanges, integration between court operational departments
document tracking and decision follow-up, improvements can be made, while respecting existing procedures”, assures Cristiano Morganti. “Against this backdrop, a number of innovative experiments are taking place in Luxembourg at the moment, putting European institutions at the forefront of the world.dial.»
Sharing knowledge
“In supporting major projects before several national and European jurisdictions, we have had the opportunity to experiment and develop our knowledge. Beyond the technical, functional and technological challenges, we were able to grasp all the dimensions of these projects, including the issues inherent in regulation, change management and the need to cultivate a digital culture within these institutions,”adds the CEO.
New technologies, such as blockchain, also offer significant potential in terms of security and digitization of procedures. Net Service, drawing on its experience in eJustice and investing in emerging technologies, intends to continue supporting the judicial world in its digitalization, both internationally and nationally.
